Meaning · English

Losing, shifting, contradicting, abandoning the thesis; a new reason; irrelevance; gibberish; obscurity; incoherence; wrong order; too little; too much; repetition; not restating; not grasping; no reply; evasion; conceding; ignoring faults; inventing faults; leaving one's tenet; false reasons: points of defeat.

When is a debate lost? Nyaya answers with a checklist. A nigrahasthana, literally a 'place of being caught', marks where a speaker has lost. Vatsyayana says the sutra divides them into twenty-two. Four concern the thesis: losing it, swapping it for another, stating one that clashes with its own reason, or denying you ever said it. One concerns the reason: switching to a new one. Eight concern the talk itself: wandering off topic, empty sounds, speech nobody can follow even when repeated, words with no connected sense, steps out of order, a missing step, a needless extra, and saying the same thing twice. Five are failures of engagement: not restating the rival's point, not grasping it, having no reply, breaking off on a pretext, and answering a charge by throwing it back, which admits it. The last four: missing the opponent's real fault, accusing him of a false one, abandoning your own school's tenet, and arguing from a reason that only looks like one (hetvabhasa). Defeat, for the Nyaya, means failing in the discipline of argument.

Picture a chess tournament. A player can lose without ever being checkmated. The clock's flag falls. He touches a piece and then refuses to move it. He makes an illegal move, or simply stands up and walks away. The board may still look fine for him. The list works the same way: a debate can be lost through these slips, long before anyone proves the thesis false.

Much of the list lines up with today's catalogue of informal fallacies taught in critical thinking courses. Shifting the thesis resembles moving the goalposts. Irrelevance is the red herring. Failing to restate the rival's view sits close to the straw man, and conceding a charge by throwing it back echoes tu quoque. Modern argumentation theory, such as the pragma-dialectical school, also writes rules for a fair discussion and counts breaking them as a failure. The fit is not exact. Some items, like repetition or wrong order, are faults of procedure rather than logic, and a modern logician would say a clumsy speaker's claim can still be true. Whether winning by such rules reliably tracks truth, or only tracks skill at debate, is still argued over today.
