Reaching a Settled Verdict

Nyaya Sutras 1.1.41

Meaning · English

After weighing a matter that was in doubt, fixing what it really is through the case for and the case against: that is a settled conclusion.

WHAT IT MEANS: When is an enquiry actually finished? Gautama's answer is nirnaya, a settled conclusion. It has two parts: the paksha, the position someone defends, and the pratipaksha, the counter-position set against it. Vimarsha is the weighing of the two against each other, and the conclusion is the matter fixed by that clash. Vatsyayana explains how that works. One side argues for its claim and answers the objections. The other side attacks the reasons and defends its own. Since both cannot stand, one must fall away, and whatever survives fixes the matter. Both sides are needed: one proves possible and the other impossible. If both stay possible, or both collapse, the doubt is still open. He adds two refinements. Opposite properties can both be true of different members of a class, as some substances move and some do not. One thing can also have both at different times. And he notes that not every certainty needs this full process. What we perceive directly is settled without debate. In formal debate and in established teaching, the conclusion is reached without this weighing. The full process of weighing case for and case against is for matters under examination.

Think of a tug-of-war with a ribbon tied to the middle of the rope and a line chalked on the ground. Both teams pull hard. The result is fixed only when the ribbon crosses the line. While the rope hangs still, nothing is decided. That still rope is doubt that remains, and the crossing ribbon is the side left standing.

Much of modern practice runs on this same idea. Courts hear prosecution and defence. Science sends papers to critics before trusting them. Karl Popper argued that a claim earns trust by surviving serious attempts to refute it, and John Stuart Mill held that you do not know your own view until you know the best case against it. Cognitive science adds a reason: people readily seek evidence that confirms what they already believe, and a real opponent corrects for that. Two points remain open. Modern epistemology usually treats conclusions as revisable and held with degrees of confidence, while the Nyaya speaks of the matter being fixed. And real questions often have more than two candidates. Vatsyayana's refinements, though, already allow that two claims that seem opposed may both be true in different cases.
